Terms and Conditions of Purchase

Introduction

This purchase is governed by the standard terms and conditions for consumer purchases of goods over the Internet. Such purchases are primarily regulated by the Norwegian Contracts Act, the Consumer Purchases Act, the Marketing Control Act, the Right of Withdrawal Act, and the E-commerce Act, all of which provide non-waivable rights for consumers. These laws can be accessed at www.lovdata.no. The provisions in this agreement should not be interpreted as limitations of statutory rights, but as a description of the main rights and obligations of the parties involved in the transaction.

The sales conditions have been prepared and recommended by the Norwegian Consumer Authority. For a better understanding, see their guide.

1. The Agreement

The agreement consists of these terms and conditions, the information provided in the ordering solution, and any specifically agreed terms. In the event of a conflict between the information, specifically agreed terms take precedence unless they conflict with mandatory legislation.

The agreement is also supplemented by relevant legal provisions governing the sale of goods between businesses and consumers.

2. The Parties

Buyer:
The consumer placing the order, referred to as the buyer.

3. Price

In Norway, the listed price for goods and services is the total amount the buyer must pay, including all taxes and additional charges. For international customers, VAT and customs duties may be displayed at checkout if supported for your destination country. If no such information is shown, the buyer is responsible for any applicable import duties and taxes.

Any additional costs not disclosed prior to purchase shall not be borne by the buyer. Shipping/postage costs are covered by the buyer.

4. Conclusion of Agreement

The agreement is binding once the buyer has submitted their order to the seller.

However, the agreement is not binding if there are typographical errors in the seller’s offer or the buyer’s order, and the other party knew or should have known about the error.

5. Payment

The seller may charge for the item once it has been dispatched.

If payment is made by credit or debit card, the card is charged immediately upon ordering.

If payment is made by invoice, the invoice is issued upon dispatch. The due date is stated on the invoice and must be at least 10 days from receipt.

Buyers under 18 years old cannot pay by post-delivery invoice.

6. Delivery

Delivery is considered completed when the buyer, or their representative, has received the goods.

If no delivery time is specified, the seller shall deliver the goods without undue delay and no later than 30 days from the order date. Delivery shall be made to the buyer unless otherwise agreed.

7. Risk of the Goods

The risk transfers to the buyer when the goods have been delivered in accordance with section 6.

Mailbox Deliveries: If the buyer chooses delivery to a mailbox, the risk of theft or damage from the mailbox lies with the buyer. Alternatives are available, such as pickup locations or lockers. Risk is transferred to the customer upon pickup. Risk during transport lies with the seller.

International Orders – Customs and Import:
The buyer (importer) is responsible for ensuring that products can legally be imported to the destination country. The seller acts as the exporter from Norway.

International recipients may be subject to import duties, customs, and fees ("import costs") imposed by local customs. These vary by country and are affected by:

  • Product type and price

  • Shipping cost and package weight

  • Customs clearance procedures

  • Local import tax rates

Some countries may waive import costs for shipments below a certain threshold. Contact your local customs office for specific information.

In some cases, import charges may appear at checkout for eligible destinations.

Returns Due to Customs:
If a shipment is returned due to customs regulations or unpaid fees, the buyer is responsible for all shipping costs to and from the destination country. These are deducted from any refund. Shipping costs are non-refundable.

Importer Responsibility:
As the importer, you must comply with all relevant laws and regulations. Customs procedures may cause delivery delays.

ID Requirements:
In some countries, customs may require ID (e.g., passport or tax ID). Always provide a valid phone number and email address during checkout.

Seizure, Destruction or Return of Goods:
Customs may seize items, destroy them, or return them to the sender.

  • If documentation is requested, it is the buyer's responsibility to provide it. No refund will be issued for seized items.

  • If items are destroyed due to import restrictions, the buyer bears the full financial loss. The seller is not responsible for knowing the laws of each destination.

Contact DHL or your local customs authority for assistance if your shipment is delayed or stopped.

Returned Orders:
If returned by customs, the buyer will be refunded for the value of undamaged items, minus all shipping costs.

8. Right of Withdrawal

Unless otherwise exempt, the buyer may withdraw from the purchase within 14 days under the Right of Withdrawal Act.

The buyer must notify the seller within 14 days. The period includes all calendar days. If the deadline falls on a weekend or holiday, it is extended to the next working day.

The deadline is considered met if the notice is sent before expiration. The buyer should submit written notice (form, email, or letter).

The withdrawal period starts:

  • The day after receiving the product

  • The day after receiving the first shipment (for subscriptions)

  • The day after receiving the final delivery (for split shipments)

If the seller fails to inform about the right of withdrawal and provide a standard form, the period is extended by 12 months. If the seller provides the information within those 12 months, a new 14-day period starts.

Returned items must be sent within 14 days of withdrawal notice. The buyer pays return shipping unless otherwise agreed. No fees may be charged for using the withdrawal right.

The buyer may test the item to assess its nature and function. If testing exceeds what is reasonable, the buyer may be liable for any loss in value.

The seller must refund the purchase amount within 14 days of receiving the withdrawal notice but may withhold payment until the goods are returned or proof of return is provided.

9. Delay and Non-Delivery – Buyer's Rights

If the seller does not deliver on time, and it is not the buyer’s fault, the buyer may:

  • Withhold payment

  • Demand fulfillment

  • Cancel the agreement

  • Seek compensation

All claims should preferably be made in writing (e.g., email).

Fulfillment:
The buyer may demand delivery unless it would cause an unreasonable burden or cost for the seller. If the issue is resolved within a reasonable time, the buyer can still demand delivery.

Cancellation:
The buyer must give the seller a reasonable grace period. If the seller fails to deliver, the buyer may cancel the purchase. Immediate cancellation is allowed if delivery is crucial to the agreement.

Compensation:
The buyer may claim compensation for losses due to delay unless the seller proves it was caused by uncontrollable events.

10. Defects – Buyer’s Rights and Complaints

If the item has a defect, the buyer must notify the seller within a reasonable time. A complaint within 2 months is always considered timely. Maximum complaint period is 2 years, or 5 years if the item is expected to last longer.

If the defect is not due to the buyer, they may:

  • Withhold payment

  • Demand correction or replacement

  • Request a price reduction

  • Cancel the purchase

  • Claim compensation

Complaints should be made in writing.

11. Seller's Rights in Case of Buyer’s Breach

If the buyer fails to pay or breaches the agreement, and it is not the seller’s fault, the seller may:

  • Withhold the item

  • Demand fulfillment

  • Cancel the agreement

  • Claim compensation

The seller may also charge late fees, collection charges, and a reasonable fee for uncollected goods.

12. Guarantee

A seller or manufacturer’s guarantee offers rights in addition to those under mandatory law. Guarantees do not limit the buyer’s rights under points 9 and 10.

13. Personal Data

The seller is the data controller for collected personal data. Unless the buyer consents otherwise, only necessary data to fulfill the agreement is collected. Data will only be shared when necessary or required by law.

14. Dispute Resolution

Complaints should be directed to the seller within a reasonable time.
